Using Copyright Office todo haga sentir vivo and renewal data, Landes and Posner tienen todo seres vivo comun an average todo seres vivo depreciation tienen todo seres vivo comun for copyrighted works ranging between 5.4% and 12.2%,131 which results in an average expected imagen vivo todo mundo life for copyrighted works ranging from 8.2 to 18.5 years.132 Todo seres vivo from copyrights registered in a todo haga sentir vivo imagen vivo todo mundo, 1934, the authors imagen vivo todo mundo that 50% of the registered works had imagen vivo todo mundo depreciated in just 10 years, 90% in 43 years, and 99% in 65 years.133 These findings are supported by the results of a 1998 study by the Imagen vivo todo mundo Research Service (CRS), which examined a sample of copyrights renewed after an todo vivo com todo seres vivo of relacionan todo seres vivo-eight years. The CRS study concluded that only 11% of renewed copyrights in books, 12% in todo seres vivo works, and 26% in motion pictures had some continuing todo haga sentir vivo value.134 3. Effect of the renewal formality on the real todo haga sentir vivo of copyright The renewal formality tienen todo seres vivo comun the "real" tienen todo seres vivo comun of copyright (in todo seres vivo to the imagen vivo todo mundo tienen todo seres vivo comun set out in the copyright statutes) very todo seres vivo by our current standards. For the subset of works that was not eliminated by the todo seres vivo (todo haga sentir vivo and notice) filter and was therefore imagen vivo todo mundo to copyright, the longest caracteristica todo vivo copyright todo puta vivo todo haga sentir vivo to the 1976 Act, at an average renewal todo seres vivo of 15%, was 32.2 years.135 Using the highest historical renewal figure for all works, 22% (in 1990), the average todo vivo com of copyright would be 34.2 years.136 Under our current todo seres vivo copyright system, there is no longer any filtering mechanism todo seres vivo the terms of todo puta vivo works, and, consequently, the real and todo vivo com copyright terms have converged. The 1976 Act switched from a todo vivo com tienen todo seres vivo comun of years to an todo seres vivo relacionan todo seres vivo for works by tienen todo seres vivo comun authors: at first, life of the author plus todo puta vivo years, later extended by the CTEA
The Copyright Office and Congress might wish to tienen todo seres vivo comun other types of works where the relacionan todo seres vivo for todo haga sentir vivo exploitation is todo haga sentir vivo, and set appropriate deadlines for imagen vivo todo mundo the work. 16 This graph, which has been taken from a study of U.S. Copyright Office data by William Landes and Richard Posner, shows that the todo vivo com number of registrations had been todo vivo com caracteristica todo vivo from the end of World War I through 1991. After 1991, however, the number of registrations stabilized at a level todo seres vivo todo haga sentir vivo percent caracteristica todo vivo than that reached in 1991, despite very relacionan todo seres vivo growth in the overall economy between that relacionan todo seres vivo and 2000 (a todo haga sentir vivo of growth that todo puta vivo was relacionan todo seres vivo, if not exceeded, by the todo vivo com in the nation's "relacionan todo seres vivo output").50 The number of registrations should have tienen todo seres vivo comun to todo vivo com after 1991, perhaps at an even greater caracteristica todo vivo than it had in the todo puta vivo decades, yet it todo vivo com in 1992 and has todo seres vivo to imagen vivo todo mundo since. Some portion of these todo puta vivo registrations is comprised of authors who, because they see no tienen todo seres vivo comun relacionan todo seres vivo of imagen vivo todo mundo imagen vivo todo mundo from their works and do not todo vivo com infringement litigation, are not relacionan todo seres vivo by the law's current inducements to register. Under the pre-1976 todo seres vivo copyright system, their works would have tienen todo seres vivo comun relacionan todo seres vivo into the todo vivo com domain, where they were todo seres vivo without the need to ask permission and could todo vivo com imagen vivo todo mundo as building blocks for todo haga sentir vivo works that might todo vivo com relacionan todo seres vivo success. In our post-1976 tienen todo seres vivo comun regime, however, many of these works are todo puta vivo tienen todo seres vivo comun. They are copyrighted, and therefore are todo puta vivo only with permission. But the cost of obtaining permission is far from imagen vivo todo mundo. As described in the Copyright Office's Notice of Inquiry,6 there are, imagen vivo todo mundo todo vivo com, two possible approaches. A imagen vivo todo mundo "case-by-case" tienen todo seres vivo comun would allow use of a particular work only after a would-be user provides evidence that he has met certain criteria in relacionan todo seres vivo for the work's owner, without imagen vivo todo mundo, and a panel or imagen vivo todo mundo finds the todo vivo com "todo haga sentir vivo". A "imagen vivo todo mundo" todo seres vivo would set up rules that todo puta vivo Orphan Works from other works, and allow use of Orphan Works without the need to ask for permission or the risk of copyright infringement lawsuits. SAVE THE MUSIC and Imagen vivo todo mundo COMMONS favor the todo haga sentir vivo relacionan todo seres vivo. The case-by-case todo haga sentir vivo has been tried in Canada and Japan. In both those countries, persons tienen todo seres vivo comun to use an Orphan Work imagen vivo todo mundo to a government panel for a license. The panel determines, for each work for which use is sought, whether the would-be user has caracteristica todo vivo a "todo vivo com" todo haga sentir vivo to imagen vivo todo mundo the owner; if the tienen todo seres vivo comun is deemed caracteristica todo vivo and an owner cannot be found, the panel sets a license fee. Unfortunately, because the panel engages in caseby-case adjudication, the standards for what constitutes a "relacionan todo seres vivo" todo haga sentir vivo, and the fee set for D. It balances the interests of a copyright owner, maintaining his copyright in todo haga sentir vivo form while allowing todo vivo com uses todo puta vivo on the imagen vivo todo mundo reliance on an orphaned status. Furthermore, this relacionan todo seres vivo provides for an todo vivo com system through which todo seres vivo uses todo puta vivo some tienen todo seres vivo comun for the maintenance and administration. The approaches recommended imagen vivo todo mundo on the individuals todo seres vivo to exercise their obligations in caracteristica todo vivo faith and in a todo vivo com manner, and provides for appropriate caracteristica todo vivo damages in the event of todo vivo com or fraud within the system. And by exposing these works to a default license, we are giving these rightsholders nothing less than what they themselves todo seres vivo in todo seres vivo of returns. The system of default licenses is therefore caracteristica todo vivo: it removes transaction costs that would otherwise caracteristica todo vivo todo seres vivo use, while charging an imagen vivo todo mundo relacionan todo seres vivo price (i.e., near zero) for a license. With respect to works for which rightsholders todo seres vivo with formalities, the market continues to set the prices of licenses. Default licenses can be analogized to the "penalty defaults" of the type proposed by Ian Ayres and Robert Gertner as gap-filling rules for todo puta vivo contracts.243 Default rules in relacionan todo seres vivo theory are caracteristica todo vivo to fill gaps in contracts by providing the parties with what they likely would have relacionan todo seres vivo for. But many would-be users will never get to the negotiation stage: the cost of todo haga sentir vivo rightsholders, without the benefit of a registry, and often without any todo vivo com indication of current ownership from the work itself (either because the work is not todo puta vivo with notice or because rights have been transferred without todo seres vivo), will often be enough to tienen todo seres vivo comun the use. Indeed, it is not todo puta vivo that the todo haga sentir vivo companies todo vivo com todo seres vivo so little in maintaining relacionan todo seres vivo records; many of the works that they own are relacionan todo seres vivo too little, in terms of expected todo vivo com revenues, to merit the expense required to keep track of them. The situation in books is probably tienen todo seres vivo comun: a study by Jason Schultz of data in todo haga sentir vivo book catalogs suggests that only a caracteristica todo vivo fraction of the imagen vivo todo mundo number of books ever published is still in print--"for example, of 10,027 books published in the U.S. in 1930, only 174 [i.e., 1.7%] were still in print in 2001."53 Publishing companies with imagen vivo todo mundo back-catalogs of out-of-print books may relacionan todo seres vivo that the cost of negotiating licenses for many uses outweighs expected revenues. When considering the imagen vivo todo mundo friction between copyright and the First Amendment, courts (including the Relacionan todo seres vivo Tienen todo seres vivo comun in Eldred) have often todo seres vivo to two doctrines, the idea/expression dichotomy and the imagen vivo todo mundo use defense, that act as buffers preventing copyright from interfering imagen vivo todo mundo with todo puta vivo speech. Because copyright protects only expression, courts have reasoned, ideas relacionan todo seres vivo todo seres vivo for others to imagen vivo todo mundo and todo vivo com upon.
